There being two votes in favour and none against, the amendment is adopted.

We shall now consider Mr Klaas's next amendment:

Quote
2. The Council of Elders shall consist of persons appointed by the Consul who are not currently serving in a role in the Government and who are not currently prevented from serving in the Assembly.

Debate is open for three days, followed by two days to vote.

Merry Christmas all!

I move that debate be adjourned until January 3 2010, if there are no objections in 24 hours, it will be done.

Hate to have to say this, but I would suggest that we should revamp this totally again, and I am one for Ascalon's realistic legal system idea where everything imaginable that we have time to write is codified into law.  Procedure, everything.

Obviously I like the current bill, I wrote it.

I also think that, for the purposes of a small micronation such as ours, simpler is better. This is especially true in constitutions, they shouldn't be overly prescriptive. I would like a constitution that outlines the governing structure, protects rights, but retains as much flexibility as possible.

If you wish to write a completely new draft constitution and propose it as an alternative to this bill, you are  entitled to do so  Smiley

-------

In terms of the current amendment, I feel this would simply make the moderative function subservient to the executive. There is no point having a moderative function if it is merely appointed by the head of the executive.

The idea behind having a Council of Elders consisting of the five previous Consul's was to try and retain some "institutional memory".

I am aware there is a typo in the bill as it presently stands, it says that the moderative function will consist of the five previous First Ministers. This is because in an earlier draft I considered doing away with the position of Consul, where this bill says First Minister it was meant to say consul. I will move an amendment to correct this typo as soon as we are done considering Mr Klaas's amendments.

I should make it clear, Klaas' amendment to this constitution doesn't make a difference to me, so I would probably vote identically with certain people.

I call the motion to a vote.

If you wish to see Mr Klaas's amendment included in the bill, vote APPROVE, otherwise, vote DECLINE.

Two days.

This vote is a draw. Normally in such a situation the chair or speaker casts the deciding vote, but we have not elected a speaker or appointed a chair person.

As such, I move that the vote be extended for another 24 hours, and I hope someone else will vote either for or against this amendment.

Onto the next proposed amendment!
