<p>2. Mr Harry Spooner is appointed to the position of Returning Officer, and is charged with fulfilling the requirements of the Returning Officer, as outlined in executive Order 003 2010.</p>
<p>3. The Returning Officer is empowered to issues regulations governing the conduct of the upcoming election, in so far as such regulations are consistent with the spirit and the letter of this order and order 003 of 2010.</p>

			<content:encoded><![CDATA[<p>1. The Elections (delay) Act 2010 calls for an election for the position of Consul on the 17th of April. </p>
<p>2. The government is unable to call elections within the legislated time frame.</p>
<p>3. Elections are hereby called for Saturday the 24th of April, 2010.</p>
<p>4. The Consul shall appoint a Returning Officer to conduct and oversee the election by the 14th of April.</p>
<p>5.The Returning Officer shall call for nominations for the position of Consul by the 15th of April. </p>
<p>6. Only citizens of the Republic, as defined under the terms of the Proclamation of the 23rd of July, are entitled to nominate. The Returning Officer may not nominate.</p>
<p>7.Citizens seeking to nominate may nominate themselves without a second.</p>
<p>8. The Returning Officer will be the final arbiter in deciding on the validity of a nomination.</p>
<p>9. Nominations for the position of Consul shall close at 5pm, Australian Eastern Standard Time, on the 22nd of April.</p>
<p>10. The Returning Officer shall email an electronic ballot paper to all citizens at 12.01am, Australian Eastern Standard Time, on the 24th of April.</p>
<p>11. The electronic ballot paper is a text document, that lists the candidates standing for election in alphabetical order, followed by the option &#8220;None of the Above&#8221;. </p>
<p>12. Citizens shall vote by compeleting their electronic ballot, and emailing it back to the returning officer.</p>
<p>13. The ballot closes at 11.59pm, Australian Eastern Standard Time, on the 24th of April.</p>
<p>14. The Returning Officer saves all electronic ballot papers to their computer, without identifying the citizen who casted the ballot in the file name. Each ballot paper will then be opened and counted, without identifying the citizen who cast the vote.</p>
<p>15. In the event that no citizen nominates to contest the election by the close of nominations, the Returning Officer will inform the Senate that the election has failed.</p>
<p>16. In the event that only one nomination is recieved, the election shall continue, with voters selecting either the candidate or the option &#8220;None of the Above&#8221;.</p>
<p>17. The Returning Officer will announce the results of the election on the 25th of April. The candidate that recieves a plurality of votes shall be declared the winner.</p>
<p>18. In the event that &#8220;None of the Above&#8221; wins a plurality of votes, the Returning Officer shall inform the Senate that the election has failed.</p>
<p>19. The government shall enter caretaker mode at the point nominations are called. At this point, the tenure of all Ministers will be suspended, and the Consul shall refrain from issuing new executive orders.</p>
<p>20. A new consul takes office at the moment the Returning Officer publishes the results of the election.</p>
<p>21. In the event the Returning Officer informs the Senate the election has failed, the previous Consul will continue to act in care taker mode until the Senate resolves the situation.</p>
<p>22. No Consul, government Minister, or other person, may use the resources of the government, or facilities they have at their disposal as a result of their service to the Republic, as part of their campaign for election.</p>

<strong>Foreign Policy of the Republic of Lavalon</strong><br />
Adopted August 2, 2009<br />
Amended August 8, 2009</p>
<p><strong>Mission:</strong> The Republic of Lavalon seeks to establish mutually benificial ties of friendship with like minded entities.</p>
<p><strong>On the Existence and Rights of Micronations</strong></p>
<p>1. A micronation is an entity that conducts itself as if it was, or was similar to: a sovereign state, a government in exile, or an organisation representating a nation-like community; and that is unrecognised by most or all sovereign states.</p>
<p>2. The political existance of a micronation is independent of recognition by other entities.</p>
<p>3. Every micronation has the right to proclaim it’s existence, organise itself as it sees fit, legislate upon it’s interests, admit citizens, negotiate and sign treatys, raise and expend funds, and issue documents to it’s citizens.</p>
<p>4. All micronations are equally entitled to exercise the rights of a micronation. The rights of a micronation do not depend upon the power which it possesses to assure its exercise, but upon the simple fact of its existence.</p>
<p>5. The Republic of Lavalon recognises the right of any person or persons to declare the existence of a micronation.</p>
<p><strong>On Recognition</strong></p>
<p>6. By virtue of our acceptance of the principles of declarative statehood, the Republic of Lavalon has in fact extended de facto recognition to any entity that, calling itself a micronation, conducts the kind of activities that a micronation is entitled to conduct.</p>
<p>7. In accepting the principles of declarative statehood in general, the Republic of Lavalon is in no way expressing an opinion on the worthiness of any claims to territory or political legitimacy that any particular micronation might make.</p>
<p>8. The Republic of Lavalon does not recognize the right of any entity to speak for people other than those who are expressly aware of and consent to their citizenship in that entity.</p>
<p><strong>On the Republic’s Engagement in Diplomatic Relations</strong></p>
<p>9. The Republic of Lavalon extends explicit recognition as a courtesy to those micronational entities with whom we wish to establish ties of friendship and mutual benefit.</p>
<p>10. The Republic of Lavalon reserves the right to be selective in the conduct of it’s diplomacy.</p>
<p>11. The Republic of Lavalon will only engage diplomatically with micronations that:<br />
a. have been in existence for at least six months;<br />
b. have functioning state like aparatus<br />
c. conduct diplomacy with civility and professionalism<br />
d. have a website that makes certain information about the micronation publically available, at a minimum there should be copies of the constitution or equivalent documents, and information on foreign policy.<br />
e. have their own domain name (eg. lavalon.info). Micronations who are members of formal intermicronational organisations or treaties to which the Republic of Lavalon is a party, are excepted.</p>
<p>12. The Republic of Lavalon will NOT engage diplomatically with entites that:<br />
a. claim a mythical or fantastical history as if it were fact.<br />
b. engage in “recwar” or other such role playing games.<br />
c. are overtly hostile to our friends.<br />
d. are in any way institutionally racist, sexist or homophic.<br />
e. are fascistic in their nature, or embrace fascistic elements.</p>
